The parties agreed to settle the dispute under CCMA case number HO17/01 between them, without admission of any guilt or liability as follows;

This agreement is an ad hoc agreement and will only be applicable to this dispute as a mechanism to settle this dispute. Further this agreement is only applicable and valid to the employees as listed in Annexure A attached to this agreement. Annexure A consist of 96 CWU members only.

Annexure A is a complete and final list and either party will make no changes or additions to this list.

The company offers to reinstate the PDMS assessments originally given to the employees by their promoters and to pay the employees the corresponding amount or the difference where the lower PDMS assessment monetary value has already been paid to the employees, whichever is applicable.

Payment will be made by no later than 15 November 2001.

The Union withdraws the CCMA referral under case number HO17/01.

This closes the file HO17/01 and is in full and final settlement on all or any claim, which may arise from the PDMS dispute.
